Terms of Service

Version 1 · Effective October 2026

These terms cover getmapgo.com, the CacheMap tool, GetMapGo Studio (its Plan and Print pages), the location-sharing page, and the GetMapGo mobile app (together, "the Service"), operated by Spanyo LLC, a Kansas limited liability company ("we" or "us"). You agree to these terms when you tap "I understand and agree" in the app or when you use the website. Our Privacy Policy explains what data the Service handles and is part of these terms.

The short version: the Service is free today and any paid features are optional; it is provided as-is; the outdoors is dangerous; and you use the Service at your own risk and with respect for the places it takes you.

1. Your safety is your responsibility

GetMapGo is a planning and navigation aid, not a safety device. Hiking, backpacking, and other backcountry travel are inherently dangerous. By using the Service you accept that:

You are solely responsible for your preparation, equipment, judgment, and safety, and for deciding whether any route or area is within your ability. You voluntarily assume all risks of the travel and activities you plan or undertake with the Service.

Release. To the extent permitted by law, you release Spanyo LLC and its members from all claims for injury, death, or loss or damage to property arising from travel or activities you plan or undertake with the Service, including claims based on our negligence (for example, a mistake in a map, route, or estimate). This release does not cover our gross negligence or willful or wanton misconduct.

2. Your license to use the Service

We give you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, and to use the website, under these terms and the rules of the app store you got the app from. You may not sell, rent, or redistribute the app; copy, decompile, or reverse engineer it except where the law allows that despite this limit; or remove its copyright, attribution, or other notices.

3. Provided "as is"

To the extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise the Service will be available or error-free, or that any output will be correct. Parts of the Service are in testing: features may change or break, and data can be lost, so keep your own copies of Atlases and files that matter to you.

CacheMap assigns geocache finds to US counties using public boundary data and automated processing. Assignments can be wrong, particularly near county lines or where cache coordinates have changed. Its statistics, maps, and exports are for entertainment.

Nothing in these terms limits rights you have under the Kansas Consumer Protection Act or any other law that cannot be waived or limited by contract. In particular, if you paid for the Service as a consumer, this section does not exclude or limit the implied warranties of merchantability and fitness for a particular purpose, or your remedies for their breach, where the law (such as K.S.A. 50-639 in Kansas) does not allow that.

4. Paid features and tips

The Service is free today. We may offer optional paid features, such as a Premium subscription. If we do:

Tips through Ko-fi are voluntary; they don't buy features, support, or any change to these terms.

5. Limitation of liability

To the maximum extent permitted by law, Spanyo LLC and its members will not be liable for any indirect, incidental, consequential, special, or exemplary damages, or for any injury, loss, or damage arising from travel you plan or undertake with the Service, even if advised of the possibility. To the same extent, our total liability for any claim relating to the Service is limited to the greater of $50 or the amount you paid us for the Service in the 12 months before the claim arose.

These limits do not apply to liability for our gross negligence or willful misconduct, or to any liability that cannot be limited by law.

You agree to indemnify and hold harmless Spanyo LLC and its members from claims by others arising from your misuse of the Service, your breach of these terms, or content you import or share.

6. Your files and content

Files you open in CacheMap and GetMapGo Studio are processed in your browser and are not uploaded to us; files in the app stay on your device unless you share them. You own your data and anything you create or export, except third-party data in it, such as OpenStreetMap map data, which stays under its own license (see section 11). You are responsible for what you do with it.

Only use files you have the right to use. When you import or open a file (GPX, KMZ, KML, a .mapgo Atlas, an image overlay, or geocache data), it must be your own or you must have permission to use it, and you must follow its license or terms of use. For example, Geocaching.com Pocket Query data is licensed for personal use; do not share it in ways its terms don't allow.

7. Responsible sharing and use

We have no tolerance for objectionable content or abusive users. Atlases, routes, waypoints, photos, notes, and files you share, and posts in our community, must not:

Please follow Leave No Trace principles and the rules of the lands you visit. Report content or users that break these rules by emailing us (see section 19) or with a report option in the Service where one is offered. We review reports promptly, and we may remove content and block anyone who breaks these rules, with or without notice.

8. Atlases you share with us or our community

When you share an Atlas, route, or other file with GetMapGo or in a GetMapGo community space (for example, by sending it to us, posting it in our Discord server, or publishing it through a GetMapGo sharing feature), you keep ownership of what is yours in it, and you grant Spanyo LLC a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, copy, modify, display, distribute, and promote it, including for commercial purposes, and to let others do so on our behalf. We may edit it, for example to remove personal details or sensitive locations, before using it. You confirm that you have the right to grant this license for everything in it (see section 6).

Atlases you send privately to other people, without sharing them with us or a GetMapGo community space, are not covered by this license.

This license does not cover third-party data in an Atlas. Map and trail data that comes from OpenStreetMap remains under the Open Database License (ODbL), whoever shares it, and we use and share it only as that license allows, with its attribution.

9. Copyright complaints

If you believe content on the Service infringes your copyright, email us (see section 19) with: your contact information; the work you say is infringed; where the content is on the Service; a statement that you believe in good faith the use is not authorized by the owner, its agent, or the law; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. If your content was removed and you believe that was a mistake, you may send a counter-notice as the Digital Millennium Copyright Act allows. We remove content in response to valid notices and block anyone who repeatedly infringes.

10. Fair use of the Service

Use the Service through the website and app as intended. Do not scrape or bulk-download map tiles or data beyond normal use, get around usage limits, interfere with or overload our servers, or try to access parts of the Service you aren't meant to.

11. Third-party data, services, and trademarks

Map and trail data © OpenMapTiles © OpenStreetMap contributors (ODbL). Maps and data also come from the US Geological Survey, the USDA Forest Service, Mapterhorn and the AWS Terrain Tiles open dataset, the National Weather Service, NOAA (tide predictions and the World Magnetic Model), and the US Census Bureau. Place search may use OpenStreetMap's Nominatim service.

Map providers you connect with your own key (such as Stadia Maps) are subject to their own terms. You are responsible for your account with them, for any charges, and for following their limits, including limits on offline storage that the app enforces. Links to outside services (such as Discord, TestFlight, Google Play, the App Store, and Ko-fi) are governed by those services' terms.

"Geocaching" is a trademark of Groundspeak, Inc. Other names and marks belong to their owners. The Service is not affiliated with, sponsored by, or endorsed by Groundspeak, OpenStreetMap, the US Geological Survey, the USDA Forest Service, the National Weather Service, NOAA, the US Census Bureau, or any of these services.

12. Community

Our Discord server is run on Discord and subject to Discord's terms, plus the rules in sections 7 and 8 and any rules posted in the server.

13. Feedback and ideas

Suggestions, feature requests, bug reports, ideas, and other feedback you send us, by email, in Discord, or any other way, become the property of Spanyo LLC. We may use, change, share, and build on them for any purpose, including commercial ones, without compensation, credit, or any other obligation to you. Please don't send feedback you don't want to give us on these terms.

14. Age

You must be at least 13 to use the Service. If you are under 18, use it with a parent's or guardian's permission, and where the law requires that permission to be given through your app store, only after it has been. Where the law requires it, the app may use the age and parental-consent information your app store provides, only to apply age-related protections and comply with the law.

15. App stores

If you got the app from Apple's App Store or Google Play:

16. Export and sanctions

You confirm that you are not in a country subject to a US government embargo, or designated by the US government as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties. Do not use or export the Service in violation of US law.

17. Changes and termination

The version number and effective date above change whenever these terms change. For a change we consider material, the app will ask you to agree to the new terms before you continue (when it has a connection, so nobody is held up in the field). Other changes take effect when posted, and continued use after them means you accept them.

We may modify, suspend, or discontinue the Service at any time, and we may end your access if you break these terms. Sections 1, 3, 5, 8, 9, 13, 18, and 19 survive the end of these terms.

18. Disputes and governing law

If you have a dispute with us, please email us first (see section 19) and give us 30 days to try to resolve it informally. These terms are governed by the laws of the State of Kansas and applicable US federal law, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Kansas, except that either of us may bring a claim in small-claims court if it qualifies. To the extent permitted by law, any claim relating to the Service must be brought within one year after it arose.

19. General and contact

These terms and the Privacy Policy are the whole agreement between you and us about the Service. If any part of these terms is unenforceable, the rest stays in effect. Not enforcing a part of these terms is not a waiver of it. You may not transfer these terms; we may transfer them as part of a merger, sale, or reorganization.
